What is the rule on notice?
The rule is well-established that registration in a public registry is a notice to the whole world. The record is constructive notice of its contents as well as all interests, legal and equitable, included therein.
Under the rule of notice, it is presumed that the purchaser has examined every instrument of record affecting the title. Such presumption is irrebutable. He is charged with notice of every fact shown by the record and is presumed to know every fact which an examination of the record would have disclosed. This presumption cannot be overcome by proof of innocence or good faith.
What if there are two titles?
In cases where two certificates of title cover the same land, the earlier certificate should prevail as between the original parties.
What are the rules on registration?
Registration must be done in the proper registry in order to bind the land. Mere registration is not enough, good faith must also be present.
