Jurisdiction over Property Flashcards
Jurisdiction in rem
Gives the LA courts the power to exercise jurisdiction over property located in the state and claimed or owned by nonresidents over whom the court otherwise lacks personal jurisdiction.
Where in rem action should be brought
in the parish where the property is located
Quasi in rem jurisdiction
Authorizes a court to impose a money judgment against a non-resident who owns property in LA even though the court otherwise lacks personal jurisdiction over the nonresident.
Commenced by attachment of the nonresident’s property
Unless the nonresident subjects himself to personal jurisdiction, any judgment rendered may only be executed against the attached properly.
