What is involuntary manslaughter?
Involuntary manslaughter is an unintentional killing committed: with criminal negligence or during an unlawful act.
What is criminal negligence for purposes of involuntary manslaughter?
Criminal negligence is grossly negligent action that puts another person at a significant risk of serious bodily harm or death.
What is an unlawful act for purposes of involuntary manslaughter?
An unlawful act can occur in one of two ways:
1. Under the misdemeanor-manslaughter rule, which is killing committed in the commission of misdemeanor; OR
2. A killing committed in the commission of a felony that is not statutorily treated as 1st degree felony murder or 2nd degree murder.
