introduction Flashcards
1) civil rights are….
legally protected freedoms and entitlements to have or do something
they concern the rights of citizens to social and political freedom and equality
2) the extent to which they are upheld…
had come into question recently now that UK has begun its departure from the EU
mainly because The Great Repeal Bill will grant parliament ‘Henry VIII’ powers, giving them the choice to scrap or keep EU law
this has been described as a “threat to democracy” as civil rights are “put at risk”
3) on one hand…
civil rights are upheld because they are protected under the human rights act, parliamentary sovereignty allows parliament to uphold them and judicial review achieves this too
4) on the other hand…
rights may not be adequately upheld because the human rights act sometimes favours undeserving individuals, parliamentary sovereignty can seem to be threatening civil rights and judicial review puts too much power in the hands of unaccountable judges
5) but overall, it is clear that…
rights in the UK are strongly upheld
