What is the usual burden and standard of proof in criminal law?
A
The burden of proof is on the prosecution and the standard is beyond reasonable doubt.
On rare occasions (e.g. the defence of diminished responsibility) the burden shifts to the defence and when this happens the standard is on the balance of probabilities.
