Intoxication covers D’s who have been charged with a criminal offence but were committing the offence under the influence of alcohol, drugs or solvents.

Dp- Rarely succeeds on the ground of public policy as a large majority of crimes are committed by those under the influence of drugs and alcohol and the public need protecting from them.
WDP- Some do question whether the courts found a balance between the two as often’ a drunken mens rea is still mens rea’
