The main problem with the law on intoxication is the conflict between LP and PP
The courts approach is that they don’t want to encourage people to drink or take drugs, nor do they want people committing crimes whilst intoxicated and using the defence as an excuse

If intoxication were always a defence the victims right would not be protected and justice would be denied

Legal principle suggests that there should be a defence for those who commit crimes when their thinking is impaired due to alcohol, drugs or other substances and therefore can’t form their mens Rea
