Test of intention is an objective one. Would a reasonable person in those circumstances through agreement was intended to be binding.
Commercial agreements - presumption it is binding
Social and domestic agreements - Presumption is NOT binding - BUT can be REBUTTED by examining circumstances and language of parties used
