Insanity Flashcards
Insanity
D suffers from a defect of reason caused by a disease of the mind, meaning they aren’t aware of what they are doing/they don’t know it is wrong - McNaughton rules.
Plea requires two doctors to provide evidence; one that is approved by the Secretary of State.
Sullivan
Epilepsy is a disease of the mind and therefore didn’t know what he was doing.
Burgess
Sleepwalking is a disease of the mind.
Bratty
A disease of the mind that only manifests in anger is not sufficient for disease or the mind.
Smith (Mark)
Sleep deprivation; heatstroke is enough for a defect or reason - absolute discharge.
Clarke
Depression isn’t sufficient for a defect of reason, as this is denying the MR.
Windle
In the case the defendant knew that helping his wife to die was a crime and therefore he did know what he was doing; not sufficient for nature and quality of the act.
