A

1) D must be suffering from a defect of reason.
2) Caused by a disease of the mind.

What is stage 1?

A

The D must be suffering from a defect of reason. This is where the D’s reasoning is impaired. It must be more than temporary absentmindedness or confusion - Clarke.

What is stage 2?

A

The defect of reason must be caused by a disease of the mind. This means a physical disease which affects the operation of the mind. Insanity is caused by INTERNALLY affected conditions.
