Share of Spouse
Spouse inherits decedents 1/2 of the CP and the following shares of the decadents separate estate:
1) if not survived by issue, parent, sibling or child of sibling the spouse gets everything.
2) If not survived by ISSUE, but survived by PARENTS, SIBLINGS or CHILD of deceased sibling 1/2 ESTATE
3) if Decedent is survived by a line of lineal decent 1/2 of separated estate.
4) If survived by two or more lines of linel decedents 1/3 of separate estate.
What is Probate?
This is the estate that could have been controlled by a will had T executed one.
Meaning of Probate
Simultaneous Death Act
- 120 hours <– Nevada does not follow
Under Uniform simultaneous Act, when parties under a will dies and their is insufficient evidence they died that than simultaneous, the property of each is disposed of had they been predeceased the descendant.
