Define procedural due process
Procedures the gov must follow when it takes away a person’s life liberty or property. Usually about notice or hearing the government must provide.
What question do you ask for due process?
Has there been a deprivation of life, liberty, or property?
In what 2 ways can a deprivation of liberty occur?
- A deprivation of liberty occurs if there is the loss of a significant freedom provided by the Constitution or a statute
- A deprivation of property occurs if there is an entitlement and that entitlement is not fulfilled.
Is government negligence sufficient for a deprivation of due process?
No, government negligence is not sufficient for a deprivation of due process.
What is needed for a deprivation of due process?
Generally, there must be intentional government action or at least reckless action for liability to exist.
Can there be a deprivation of due process by the government in an emergency?
Yes, in emergency situations, the government is liable under due process only if its conduct “shocks the conscience.”

What is the test for what kind of procedural due process is needed?
The test is to balance the following factors:
i) The importance of the interest to the individual
ii) The ability of additional procedures to increase the accuracy of the fact-finding
iii) The government’s interests
What is the government’s interest usually in a procedural due process balancing test?
Gov’s interest is usually an efficiency in saving money
Before a person’s welfare benefits can be terminated what must the government provide?
there must be notice and a hearing.

there only has to be a post termination hearing.
When a student is disciplined by a public school what must the school (government) provide?
there must be notice of the charges and an opportunity to explain. (no trial hearing needed)

does not need any due process
