Q

Procedure for Indictable offences

A

D is charged with an indictable offence
D appears before a Mags Court and enters a plea
Mags deal with any preliminary issues such as legal representation and bail
Case is referred to the Crown court for a case management hearing
At the case management hearing a date is set for trial
Trial will take place before a judge and a jury; judge will advise the jury on points of law
The jury will decide the verdict
If the jury finds D guilty, the judge will sentence D. As the offence is indictable only, the likely sentence is a custodial sentence
