Q

When is the Defendant regarded as having Intent to Commit the Full Offence?

A
  • Under the facts as the Defendant believed them to be, they intended to execute the Offence to completion.
  • This is so even if the Offence has a Mens Rea of either Intent or Recklessness.

Oblique and Conditional Intent suffice.
