D was arrested by customs officials with a suitcase which he ‘confessed’ contained controlled drugs. However, analysis of the contents showed that it actually contained simple vegetable matter (ie not controlled drugs). D was charged with attempting to be knowingly concerned in dealing with a controlled drug.39

Crown Court: guilty of attempting the drugs offence.

Court of Appeal: conviction upheld on appeal.

House of Lords: appeal dismissed—Anderton v Ryan overruled.
