When is imprisonment used in the criminal justice system?
Used for more serious crimes
What is the maximum sentence a magistrates can give?
Up to 6 months
What are the 3 types of sentences a court can give?
- Determinate (sentence with a fixed date)
- Suspended sentence (not imprisoned unless an offender recommits)
- Indeterminate/life (life=15 yeas but can have more)
When is a life sentence given?
For serious cases (e.g. murder)
How is release considered for those serving a life sentence?
A judge will set the minimum amount of time before release of parole is considered and if considered it must be safe and sustainable. If released on license it will be for life and must follow rules or sent to prison.
In 2018, how many people had indeterminate sentences?
10,000/14% of prison population and highest in Europe
How many people were on a determinate sentence in 2021 in the UK?
65,000-75,000
What happens when someone is given a determinate sentence for less than 2 years?
They are released halfway through on license and at the end will be subject to supervision and any breaches will cause a trial in the magistrates
What happens when someone is given a determinate sentence for more than 2 years?
Released halfway through on license and will be supervised with conditions and if breached the person will be recalled and go to prison
