What is Pre-Trial Diversion and Civil Citation?

A

The State has discretion to “divert” the child from formal court proceedings.
Typically recommended by DJJ probation officers and approved by the State Attorney.
The State agrees NOT to prosecute if the child agrees to certain conditions.
A civil citation is a form of diversion and can also be issued. The child may be referred to immunity services or appropriate intervention services.
