What are 6 good reasons not to follow Formal ID Procedures?
R- suspect REFUSES to take part and police don’t have photo or vid that shows a true likeness of suspect
S- suspect has SINGULAR appearance. Unique, distinctive, cannot be disguised
A- suspect has substantially changed their APPEARANCE after offence & before it was practical to hold formal procedure
C- ID made to officer after CHANCE meeting between person who made ID and suspect
S- ID of suspect SOON/ immediately after offence was reported.
I- no officer or prosection could have reasonably anticipated identification would have been an ISSUE at the trial. Eg. Witness knows persons from somewhere.
What are the 4 main points specifIc to a Photo Montage?
- Suspect’s photo must be place amongst 7 others
- All photos devoid of identity
- No assistance to be given to witness
- Once a witness has made an ID you must decide if you want other witnesses
