Gravamen
The essential element or main part of a legal dispute or claim
Equal Treatment
Everyone is equal under the law and has the right to equal protected and benefit of the law
Bias
Against or in favor of one of the parties of a class or persons
Respondent
Party who is required to answer a petition for a court order
Adverse Impact
Having a harmful result. Sometimes treating everyone the same will have a negative effect on some people
Undue Hardship
Any action that causes unnecessary stress
Harassment
Behaviour (verbal, written, etc) that is unwelcome/unwanted and can offend/humiliate an individual
Accommodate
Sometimes it is necessary to treat someone differently in order to prevent or reduce discrimination
Constructive Discrimination
Occurs when a seemingly neutral requirement has a discriminatory effect (or adverse impact) when applied to a group protected under the Code
Bona Fide Occupational Requirement
Sincerely believed to be necessary, and in an objective sense, necessary for safety, efficiency or economy
Mediation
Intervention in a dispute in order to resolve it
Remedies
To achieve justice in any matter in which legal rights are involved
Affirmative Action
Set of procedures designed to; eliminate unlawful discrimination among applicants, remedy the results of such prior discrimination, and prevent such discrimination in the future
Poisoned Environment
A form of discrimination and can arise from even a single incident, regardless of a persons status.
Conciliation
An informal and confidential process in which a neutral person, the conciliator, helps you and the other party find a satisfactory solution to your dispute. (Similar to meditation)
