where do HR come from
many different theoretical approaches:
modern HR systems = found in treaties - which are legally binding on countries which accept them and the UK accepts many of the core UN and council of europe treaties
rights and freedoms are written in treaties and gov is legally bound to respect these and held to account on an international level by UN or CoE
early recognition of HR
most religious texts, many philosophies and historical protection of individuals include some diplomatic laws e.g. law of aliens (foreigners) and later agreement of prohibiting slavery
some countries enshrined HR in documents like constitutions e.g. uk magna carta 1215 and bill of rights USA 1791
WWII - after attempted to create international organisation to maintain peace and oversee transferees of land and ppl - league of nations which oversaw these and minority rights guaranteed and international labour organisation was established which concerned workers rights
universal declaration of HR 1948
adopted by general assembly 10/12/48, no country has denied to use it and the 8 countries who abstained now accept it and NOW a legally binding treaty
