What does s 5 (1) state of HOTA
It states that the designated officer in the hospital approves of the removal of an organ for transplanatation when the person hs died except where the person is a non citizen and not a permamannet resident, under the age of 21 unless with the consent of the guardian or parent and those who do not / object to the removal of organs after they have died can register their objection.
What happned in Tang wee sung
In this case, Tang wee sung paid suliamain 300000 for a kidney. He was desperate to live and the courts took a sympathetic approach to impose liability on the parties. Tang was a businessman while sulamain was a poor man. The courts fined sulamin 1,000 for management of the sale of an organ while the courts fined Tang 7,0000 along with one day imprisonment. the courts took into account the fact that Tang did not approach any of his family members for a transplant. some say this was too harsh for tang due to sulamain being the one who benefitted due to consideration.

It still did not yield enough donees, and docotrs focused on the brain death rather than cardiac death. Leaves out non heart beating patients. Also it is not possible to know if a patient with brain death will go into donation and it is unethical and morally wrong to discuss trnasplanation to next of kin

What was proposed?
To switch to a mandated consent because it will reduce ambiguity and lay out the patients preferences clearly. Also said to include foreginers with long term passes under the HOTA since they can become donees under mtera as it will increase donee, Donation after cardiac death too and it should be maintianed by techonlogy.
