Warrantless DUI in a residence: If a subject flees from the scene and enters a residence, an officer may enter that residence without a warrant as long as the officer has probable cause to believe the following:
- driver is DUI
- DUI is an element of the crime being investigated.
- driver is in the residence
- the time is brief enough that it is believed the alcohol is still in the blood.
- BAC is in danger of imminent destruction.
