What does Montgomery Consent involve?
Inform any material risks involved in a proposed treatment and of reasonable alternatives.
Understand patient’s views and preferences about any proposed investigation or treatment and the adverse outcomes they are most concerned about
Do not make assumptions about the patient’s understanding of risk or the importance they attach to different outcomes
What is classified as a ‘material risk’?
If a reasonable person in the patient’s position would be likely to attach significance to it, or if the practitioner is, or should reasonably be aware, that the patient would be likely to attach significance to it - then the risk is classed as material.
When did the UK adopt Montgomery consent?
2015
What are the principles of informed consent?
It must be:
- Given voluntarily.
- Given by an individual who has capacity.
- Given by an individual who has been fully informed about the issues bearing in mind the obligations of Montgomery and GDC Standards.
- Given anew when material risks change or when treatment options or treatment changes
- Given with the patient’s knowledge that they can withdraw consent at any time.
What is the age of legal capacity?
16 in Scotland
18 in England
What is Gillick competence?
When children <16yrs can consent to tx with the understanding that they have the mental capacity

The overarching body of the GDC
What can you do to effectively communicate with your patients?
