What was ‘Article 48’ and why was it a weakness for Germany?

A
  • Article 48 said that, in an emergency, the president did not need the agreement of the Reichstag, but could issue decrees.
  • The problem with this was that it did not say what an emergency was, and in the end, it turned out to be a back door that Hitler used to take power legally.

  • Weaknesses in the Weimar constitution crippled the government, for example proportional representation frequently meant there wasn’t a majority in the. Reichstag which delayed decisions and led to Hindenburg taking control with the power of ‘Article 48’.
  • When the crisis came in 1929 there was no one willing or able to speak out against Hitler’s campaign
  • Bias right wing judges meant that Storm troopers and other associates of the Nazi party could get away with using violence

  • Nazi propaganda persuaded the. German people that it was the fault of the Jews, Communists and Weimar Government that Germany was in such a bad political, economic and social state.
  • Radios were sold cheaply to make sure Hitler’s speeches could be heard by the masses and reach a large audience

  • Wall Street Crash caused all loans from USA though Dawes Plan had been recalled
  • Unemployment reached 6 million, people starved on the streets
  • People wanted someone to blame and looked for an extreme solution- which was what the Nazi party offered
  • Nazi seats in the Reichstag grew from 12 in 1928 to 230 in 1932

Why did Hitler come to power: Recruited by Hindenburg

  • In November 1932 failed to get a majority of seats in the Reichstag (their share of the vote fell from 230 seats to 196)
  • Hitler contemplated suicide
  • Franz von Papen (a friend of Hindenburg) was Chancellor but couldn’t get enough support from the Reichstag
  • Hindenburg and vom Papen had to govern by emergency decree under article 48 of the Constitution
  • They offered Hitler vice-Chancellor if he promised to support him but he refused demanding he be made Chancellor
  • On January 30th 1933 Hindenburg made Hitler Chancellor
