1st amendment
The freedom of speech, assembly , press, religion, and petition. Petition press and assembly must be in a peaceful manner
2nd amendment
The right to bear arms. Allowing people to keep guns Incase the British were to return along with keeping a well maintained militia
3rd amendment
No quartering of soldiers. Without someone’s permission you cannot force them to take a soldier in and feed them.
4th amendment
Unreasonable searches and seizures. YOu cannot enter a property without a judge given warrant which needs evidence to back it up. You can also secure your home, persons, papers and effects.
5th amendment
The due process of law, everyone must follow the rules when making an arrest. The police have to go to a grand jury to get a court date with evidence. Double jeopardy, no self incrimination, duprocess, and just compensation. If the state needs your property they must pay you the market price.
6th amendment
The right to a fair, speedy, public trial. Along with the right for everyone to have a witness and a defense attorney.
7th amendment
Everyone is entitled to a trial by jury in cival or money cases.
8th amendment
No cruel and unusual punishment. Decided by the court. ie the death penalty
9th amendment
Non enumerated rights. Everyone is protected by the constitution even if it is not stated in the constitution. Mainly used for medical controversy and otherwise ignored by the court.
10th amendment
The states rights. The federal government will never have to much power of the states that they can overrule them.
House of congress
The house of congress is the house of representatives and the Senate together; the legislative branch. Impeaches federal government representatives, deal with revenue on bills and decide the president with an electoral tie.
3 branches of government
The three branches of government are the legislative, executive and judicial branch. Created with different tasks to stop one branch from becoming too powerful over the others. Legislative is house of congress along with others parts, they create laws, declare war, and control taxes. The executive branch is tasked with enforcing the laws also president. The judicial branch holds the Supreme Court which determines wether a new bill in constitutional or not.
Articles of Confederation
Originally created to unite the colonies under one main form of government document and stop a monarchy from forming. It didn’t allow any main form of government that could tax, declare war or use a postal system. The main problem with the lack of taxes was a major debt.
Shays rebellion
Since the US had no money the different states began to print their own forms of money that weren’t worth anything. So the farmers who were former soldiers were promised now worthless money. Daniel Shay a farmer raised about 100 farmers who stopped the judges who shut them down from coming in.
Constitutional Convention
After seeing the problems with the lack of money in the US and the no major form of government James Madison and Alexander Hamilton wanted to start a whole new form of government. Called together a delegate from each state in Pennsylvania in July. 55 delegates came together and they discussed two main problems. How to defy power between state and federal government and how much authority should each branch have. Was all corded but kept a secert to the press at the times. Decided on three branch’s and the how to elect representatives.
Fedralists
People who believed that a strong governement and the constitution were a good thing for the country. Normally worked on the coast in finance and trade.
Anti fedralists
People who were against the constitution, believed that the states should have more power of the federal government.Lived in rural areas.
Living Document
The constitution because it’s always being added to and change by the government
Electoral vs. Popular vote
Electoral vote is based on the number of house of congress representatives in each state. Wanted to stop uneducated votes at the time but doensnt matter not that the majority are educated.
Fedralism
Advocates for an untied country under a federal government. Requires basic government systems to work properly.
Checks and Balances
Separate power between the thee branch’s so no one branch can over rule the others. Gives each branch ways to respond the each other.
Judicial Review
Gives the Supreme Court the power to interpret the constitution to not allow some bills to turn into laws.
Veto
The legal power to stop a federal action in government. The president can veto a bill as well as the legislative branch can do the same.
Impeachment
Charges against a government official that can have the per entry revoked from office.
Bicameral
Was discussed in the constitutional convention and was the Virginia plan. Allow the government to have two main bodies to create laws. The two today are the senate and the House of Representatives.
Popular Sovernigty
Created by Steven a Douglas in the Kansas Nebraska Act. It allow the two territories to when they had enough people to become one, decide on wether they would be a free or a slave state.
James Madison
Was considered the father of the constitution. He brought together the constitutional convention to create a new form of government. He was a federalist who also worked on the federalist papers. He was also the person who recorded everything that happened in the constitutional convention and decided it shouldn’t be public. A congressman and the 4th president of the United States. He also created the Virginia plan, that the government should be Bicameral and based in the population of states.
George Washington
Was the first president of the United States and was the reason the presidential term limit is two. He came back into political after Shay’s rebellion and was the president of the constitutional convention. He showed great leadership and character.
William Patterson
Created the New Jersey plan with the way to elect representatives. Have a strong government with three branches. Be unicameral or have one legislator bases on the number of states for representation.
Rodger Sherman
Created the great compromise, in between the two plans for government. The government system should be bicameral and the House of Representatives should be based on population and the senate should be two per state, appealing to both sides.
Double Jeopardy
You cannot be tried for the exact same crime twice.
Manifest Destiny
American settlers were destined to travel to the west by good and this image of angels. It also was designed to remove or destroy the Native American population.
