Hearsay
Hearsay is an out of court statement offered to prove the fact of the matter asserted. Hearsay is inadmissible unless an exception or exemption applies.
Non hearsay
There are 4 categories that are considered nonhearsay:
- Prior identification
- Prior inconsistent testimony
- Prior consistent statement for motive/ influence
- Statement of opposing party
Nonhearsay to prove it was said
- Verbal or legal act
- State of mind
- Effect on listener
Hearsay exception requiring declara to to be unavailable

- Former testimony
- Dying declaration
- Statement against interest
- History (family or personal)
- Residual
Hearsay exceptions

- Present sense impression
- Excited utterance
- Then expiating state of mind
- State meme for medical treatment
- Recorded recollection
- Records
Former testimony exception
- Unavailable
- Testimony given at prior proceeding
- Admitted against party that had same motive and opportunity to develop statement.
Dying declaration exception.
- Unavailable
- Made under belief of impending death
- Relates to cause or circumstances of death
- Homicide or civil cases only
Statement against interest
- Unavailable
2. Made statement that declarante knew was against his interest at the time they made it.
History
Statement made regarding person or family history such as birthdates and marriage
Present sense impression
- Statement that describes or explains an event
2. While it’s happening or immediately after
Excited utterance
Statement made in response to event while declarante is under stress of event and statement related to the event.
Business record exception
- Record made in regular course or business
- Regular practice of business to make record
- Made by person with duty or knowledge
- At or around the time of the matter described
Then exhausting state of mind
- Then existing state of mind (MIMIC) or
2. Emotional sensory or physical condition
Statement made for medical diagnosis or treatment
- Made and reasonable pertinent to medical diagnosis and treatment
- Describes medical history or symptoms
Past recollection recorded
Record made on matter witness once knew about but now cannot remember enough to testify fully and accurately.
