When was the Fire Safety Act introduced and what does the update set out?

A

Following the Hackitt Review (2018), the Fire Safety Act (2021) reforms the Regulatory Reform Order 2005 as it relates to multi-occupied residential buildings,

Introduced as an update to the Fire Safety order 2005

The Act requires:
1. Regular inspections of lifts to be reported to fire and rescue services
2. Ensure evacuation plans are regularly updated
3. Ensure residents are provided with suitable fire safety instructions
4. Ensuring individual flat entrance doors comply with current standards where the external walls have unsafe cladding
5. Clarifying that the responsible person or duty-holder for multi occupied, residential buildings must manage and reduce the risk of fire.

What is an EWS form?

A

A fire review certificate

Following reviews of building safety after Grenfell many external wall system were found to be unsafe - led to blight on values as lenders are withdrawing mortgage finance.

External wall system
Following a review of building safety subsequently to the Grenfell fire, many tall residential buildings external wall systems have been found to unsafe. The EWS1 form enables a qualified professional to confirm that an external wall system on resi buildings has been assessed for safety

The RICS and mortgage lenders jointly formed the EWS1 form as a away mortgage lenders assessing the external wall safety of buildings over 18m.

A

Occupiers Liability Act 1957?

A

The act regulates the liability of occupiers for injuries caused to lawful visitors, as well as for damage caused to any goods, as a result of dangers due to the state of the property.

A common duty of care is imposed to lawful visitors, it is not only occupiers who may be liable to lawful visitors but also those who have control over premises such as landlords.

Trespasses are covered by the occupiers liability act 1957

What is asbestos?

A

It is an insulating material which can cause serious health problems and fatal diseases. When it is disturbed and damaged it can cause very small toxic fibres which can lodge in your throat.

What are the Construction (Design & Management) Regulations 2015?

A

Construction Design and Management (CDM) Regulations (2015)
- it is a criminal offence policed by health & safety executives (HSE) to breach CDM regulations
- relates to the design of all commercial and residential developments
- The aim of CDM Regulations is to ensure that Health and Safety is considered throughout the development process from conception to demolition
- Applies to all building and construction work and includes new build, demolition, refurbishment, extensions, conversions, repair and maintenance
- The main duty holders are; the client, Principal Designer & principle contractor

Used when a project lasts longer than 30 construction days with 20 or more workers working simultaneously on site.
