What is asbestos?
Insulating material made up of tiny toxic fibres that can lodge in the lungs and cause serious harm.
Can’t cause harm if left undamaged/disturbed.
Three types in the UK: Brown & Blue were made illegal in 1985 and white in 1999.
It is thought over 4m props contains asbestos and it kills 5000 people a year
It is a criminal offence not to manage.
What is the legislation on Asbestos?
Control of Asbestos 2012 - Obligations of duty holder, survey to make material assessment, non-licensed work need to notify HSE and needs to be recorded
What types of asbestos surveys are there?
- Management - locate, assess & advise on management during normal occupation
- Refurb/demo - required for demo/refurb - samples of suspect materials taken and analyzed, recommendations made
Who’s role is it to manage asbestos?
Duty Holder
Who is the duty holder? What’s their obligations?
The owner of the building if vacant and the occupier/property manager if occupied.
Must undertake risk assessment, manage risk, have a written plan, implement it and review.
All work carried out by licensed contractor

- Assess risk and create mgmt plan

- review register regularly (HSE recommends 6 monthly)
Punishment for asbestos?
H&S Act 2008
£20,000 fine and 12 months
Higher court there are no limits
