A new assessment must be carried out whenever there are significant changes to the building, its use, or occupancy.
What is the Defective Premises Act 1972?
Those who build or maintain a property (like landlords, developers, or contractors) have a duty to ensure it is safe for people living in or affected by it. If they fail and someone is injured or suffers loss, they could be held liable.
Building Safety Act 2022 - has extended the period of liability from 6 years after the date of completion of the works to 15 years for a claim arising after June 2022.
What is included in a risk assessment?
Identification of Hazards – Spotting anything that may cause harm (e.g. fire, chemicals, trips, working at height).
Who Might Be Harmed and How – Identifying people at risk such as employees, visitors, or contractors.
Evaluation of Risks – Assessing the likelihood and severity of harm and deciding on precautions.
Control Measures – Recording existing controls and identifying any further action needed to reduce risk.
Record of Findings – Documenting the results of the assessment and the action plan.
Review and Update – Regularly reviewing and updating the assessment, especially if there are changes in the workplace or an incident occurs.
