Section 2 - Duties of Employer to Employees

To ensure so far as reasonably practicable the health, safety and welfare at work of employees through:
Safe plant and systems of work
Safe use, handling, storage and transport of goods and materials
Provision of information, instruction, training and supervision
Safe place of work including access and egress
Safe and healthy working environment and welfare arrangements

Section 3 - Duties of Employers and Self-Employed to persons other than employees

A

The employer shall so far as reasonably practicable:
Not expose them to risks to their health and safety
Give information about risks which may affect them

Includes visitors, contractors and members of the public

Section 4 - Duties of those in control of premises

A

Anyone in control of premises or plant used by persons not in their employment must:
Ensure safe access and egress to premises and plant
Ensure that plant or substances int he premises are safe and without risk to health

These duties are often transferred to the tenant.

Section 6 - Duties of those who manufacture

A

So far as reasonably practicable:
safe design, installation and testing of articles
substances that are safe and with our risks to health
carry out or arrange for tests or examinations to ensure safe deign and construction of articles and ensure substances will be safe and without risk to health
provision of information on use and conditions essential to health and safety, and information about new and serious risks which come to light
carry out research to minimise risks
erectors and installers of articles for use at work must ensure they do not make the article unsafe or a risk to health
Importers and suppliers carry the same duties as designers and manufacturers.

Section 7 - Duties of Employees

A

Take reasonable care of their own health and safety and that of others who may be affected by their acts or omissions
Cooperate with the employer so as to ensure that the employer can comply with their statutory obligations

Section 8 - Duties of all persons

A

No person shall intentionally or recklessly misuse or interfere with anything provided under the HASAWA 1974 and other legislation in the interests of health, safety or welfare.

Section 9 - Duty of the employer not to charge

A

The employer SHALL NOT charge employees for anything carried out or provided to comply with specific legal obligation, provision of personal protective equipment, health surveillance, welfare facilities etc.

Section 36 - Offences due to the fault of another person

A

Where the commission by any person of the breach of legislation is due to the act or default of some other person, then that other person shall be guilty of the offence and may be charged with and convicted of the offence whether or not proceedings are taken against the first mentioned person.

Section 37 - Offences by the Body Corporate

A

Where there has been a breach in legislation on the part of a body corporate. The offence can be “proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of any director, manager, secretary or similar officer of the body corporate, he, as well as the body corporate, can be found guilty and punished accordingly.”
