Accomplice Liability
A
A. Principal Person: Full criminal responsibility/ Direct liability
B. Accessory/ Accomplice: Derivative liability because he is an aider and abettor even if he didn’t participate in each single element.
C. If D didn’t have a realistic opportunity to quit the crime,there is no intent to assist a crime.
MPC: A person is an accomplice if, he
- Solicits other people to commit it; OR
- Aids or agrees or attempts to aid another person in planning or committing it; OR
- fails to prevent the commission crime even though he had a legal duty.
