Facts: d was anaesthetist, he failed to notice that the tube supplying oxygen to v became disconnected, v suffered Brain damage and died 6 months later
Ratio: d’s failure to react was abysmal
R v Singh
Facts: d was landlord of a property which a faulty gas leak fire caused death of tenants
Ratio: duty of care exists in different situations
R v wacker
Facts: immigrants found dead at back of lorry due to a closed vent
Ratio: clearly assumed the duty of care
R v stone and Dobinson
Facts: d’s failed to look after girl who was suffering with anorexia, she died as a result
Ratio: d’s assumption of responsibility to the v
R v Bateman
Facts: d was a doctor. v’s uterus came away during childbirth, d did not send v to hospital for 5 days, and she later died
Ratio: he had carried out the normal procedures that any competent doctor would have done. He had not been grossly negligent
R v misra and srivastava
Facts: d’s were doctors who failed to identify and treat v for an infection. D died from infection
Ratio: adomako test did not infringe convention rights
