Admission of Evidence
Evidence that comes to the jury’s attention/awareness
Proponent
The person that offers the evidence
Opponent
Person who objects to the evidence entering the jury’s awareness
Proffered Evidence
Item of information the proponent is offering
Objecting to Evidence
Opponent believes the evidence is inadmissible and wants the judge to exclude it from entering the jury’s awareness
Exclusion of Evidence
Abuse of Discretion = when no conscientious judge, acting intelligently, could honestly have taken the view that the trial judge took
Offer of proof
Outside the jury’s hearing, proponent makes a statement (which is recorded) that the jury would have heard the following evidence had the trial judge not excluded it, so the App. Ct. can later determine if the trial judge erred in excluding the evidence.
