what is an easement?
An easement is a nonpossessory right to use and/or enter onto the real property of another without possessing it
what is an implied trust?
implied trusts of land are not required to be evidenced in writing and do not require the signature of the settlor Law of Property Act 1925, s.53(2)
what is a restrictive covenant?
a covenant imposing a restriction on the use of land so that the value and enjoyment of adjoining land will be preserved
what is considered a trigger event?
when you possess land which is unregistered or when you mortgage it
what leases take effect at law?
those that comply with the formalities of s1(1) LPA 1925 - be made by deed
must be signed witnessed and delivered as a deed (s1(3))
what is a registrable disposition?
a disposition ( s27 identifies what is considered as a disposition, i.e. transfer, certain types of leases, and the grant or reservation of an easement ), that must be registered to take effect at law
