General Community Property Principles
California is a community property (CP) state.
CP is applicable to the marital economic community, beginning upon marriage and ending upon divorce, death, or permanent physical separation with intent not to renter the relationship with his spouse.
General Community Property Principles (CP vs SP)
Anything acquired during marriage, while the couple is domiciled in California, is presumed CP, unless the presumption is rebutted. Anything earned or obtained before marriage
Anything earned or obtained before marriage, during separation, or following divorce is separate property (SP).
Additionally, any inheritances, gifts, devises, and bequests acquired during marriage is also SP.
Quasi Community Property (QCP)
Quasi community property (QCP) is any property acquired by a spouse or couple while domiciled in a non-CP state that would have been CP had the spouse or couple been domiciled in California at the time of acquisition
