Action
A case which is commenced by a claimant against a defendant in a civil court.
Attendance note
An attendance note will be completed to record what was discussed and decided during an interview.
Barrister
A barrister has passed the examinations set by the Bar Council and completed training. Their main area is to appear in court as advocates.
Chambers
Offices used by a barrister.
Chartered legal executive
A Fellow of the Chartered Institute of Legal Executives. They carry out similar duties to a solicitor.
CILEx
The Chartered Institute of Legal Executives is an awarding body and sets the professional standards.
Civil procedure rules
The rules which apply to Actions in the civil courts.
Common law
Same principles were adopted in the different parts of the country. Law made by judges.
Confidentiality
Anything said will not be casually discussed. Client’s details must never be disclosed to any third party without the prior approval of the client.
Conflict of interest
A solicitor is not usually able to act for both parties in a case. If there is a conflict of interest the solicitor must refuse to act.
Delegated legislation
Parliament passes its law making power through an ‘enabling Act’ to other people to alter the law.
Disclosure of documents
Parties to an Action must disclose to each other documents in their possession relating to that Action.
Draft
A ‘working’ document. It may be altered until everyone is happy with the content.
DX
Document Exchange. A private postal system used by solicitors.
Endorsement
Backsheet. Indicates the type of document.
Engrossment
The final version of a document with all the agreed alterations.
Execution
Signed (executed) by all the parties to the document.
Fee earner
Anyone who earns fees for the firm.
Hatching plans
Plan attached to documents have the appropriate portion of land indicated by hatching or colouring or outlining.
