- What must a police officer do if they are the respondent of a PO order?
- What must a police officer do if they are the applicant of a PO order?
- Report in writing to supervisor who must inform HR manager, etc. Non-disclosure could be aggragating factor. CoC applies
- encouraged to report confidentially to welfare officer and/or supervisor so support provided
Can constables subject to a PO carry firearms & appointments?
No, this breaches the order.
Can parents take out a protection order against a child or young person?
No, this must be dealt with inder the provisions of the CYPF Act 1989
Who can issue protections orders?
The Family Court as well as the District Court when required.
Who can be protected on a protection order? (4)

- Applicant’s children under 17 years
- Applicants children 17+ years while living at home
- Specifically named person, domestic relationship
(Children nor living at home need to be named specifically or on separate order)
After the District Court determines that a temporary protection order is to be issued, what can be done with the respondant?

When can the Distict Court issue a ‘final’ protection order?
When sentencing an offender convicted of an offence involving domestic violence.
(Believes it is necessary and victim agrees)
What are the standard non-violence conditions on a protection order (4)
Must not:
- physically or sexually abuse (or threatens)
- damage property (or threatens)
- engage in intimidating or harassing behaviour that amounts to Psychological abuse.(or threatens)
- encourage other person to do above
What does psychological abuse incude with regards to a protection order? (5)

- harassment
- damage to property
- threats of abuse (physical/sexual/psychological)
- financial abuse
- causing child to see/hear abuse
When is the ‘non-contact condition suspended on a protection order?
When the protected person and respondent are living in the same house with the express consent of the protected person.
(consent can be withdrawn by protected person)
