Inverse Condemnation
If an adjacent public land use diminishes the value of the owner’s property but the property has not been condemned for public use, the owner may claim compensation
Comprehensive Plan (Master Plan)
Created by local government and usually covers land use, housing needs, movement of people and goods, community facilities and utilities, and energy conservation
Zoning Ordinances
Local laws implementing the land uses designated in the comprehensive plan and cover items such as permitted uses, lot sizes, types of structures, building heights, setbacks, style and appearance of structures, density, and protection of natural resources.
Buffer Zones
Separating residential from nonresidential areas
Restrictive Covenant
An agreement you make with when purchasing property that limits the way you can use a property
Easement
A right to cross or otherwise use someone else’s land for a specified purpose.
Covenants, conditions, and restrictions (CC&Rs)
A set of rules governing the use of a certain piece of real estate. Typically have time restrictions
Gross Easement
Selling rights to the land to another person, but without giving them legal ownership
Dedication
Voluntary transfer of private property to the public for public use (streets, schools, parks)
