Guidance

  1. The right to retain and use personal possessions
    • including furnishings
    • clothing as space permits
  2. All residents possessions, regardless of value must be treated with respect

Procedure

  1. Determine if it was appropriate for staff to retain personal possessions from residents due to insufficient space, protection of health and safety, and maintaining other resident rights, and if reason for the restrictions was communicated to resident

Non compliance examples

  1. Discouraging residents, families from bringing in personal items to the facility.
  2. A decision to refuse a resident his personal belongings not on the basis of limited space and/or health and safety of the other residents being infringed.

483.10-The right to reside and receive services in the facility with reasonable accommodation of resident needs and preferences except when to do so would endanger the health and safety of the residents.

Intent :

Accommodating residents needs and preferences creates an individualized and homelike environment

Definitions

“Reasonable accommodation of resident needs and preferences”-means to make the physical environment more individualized to the resident.

Guidance: Reasonable accommodation of resident needs and preferences includes, but is not limited to

1. Individualizing the physical environment of the residents bathroom and bedroom 
2. Individualizing common living areas 

What does this do? It can assist the resident in maintaining and /or achieving independent functioning, dignity, and well being.

Resident seating should appropriate seat height, depth firmness and with arms that assist residents to independently rise to a standing position.

Procedures

  1. Surveys will be observing residents in their living and common areas, evening interviewing them to see if their environment accommodates their needs and preferences. They will also look at staff keep needed items with the residents reach and provide the necessary assistance to help maintain the residents independence. Call light within reach.

Examples:

  1. Storting a wheelchair or other adaptive equipment out of reach of a resident who is otherwise able to use them independently.
  2. Storing eyeglasses out of reach
  3. Having areas of worship inaccessible to residents with mobility limitations
  4. Not providing a riser on a toilet to maintain independence.

  1. 10 e (4)-Right to married couples living in the same room when both consent to the arrangement
  2. 10 e (5)-The right to share a room with a roommate of the residents choice and both consent to the arrangement.
  3. 10 e (6)-the right to receive written notice and the reason for the change before the residents room or roommates is changed.

Guidance:

  1. Have the right to share a room with whoever they wish as long as they’re in an agreement-(opposite sex, same sex, married, domestic, siblings, friends)
  2. Residents do not have a right to demand a resident to replaced to accommodate a married couple.
  3. Different payment source residents cannot stay together
  4. When residents are going to be moved, the resident and/or representative must have written explanation of why the move is required. The resident should be able to meet the resident and see the room etc before being moved.
  5. Social services should be there to help a roommate grieving over the death of a resident.
