	The 1st Amendment assures that &ldquo;Congress shall make no law respecting the establishment of religion, or prohibiting the free exercise thereof.&rdquo;  </p>

| Free Exercise Clause, When Violation Occurs</p>

Three scenarios give rise to a violation of the Free Exercise Clause</p>

1. Government prohibiting behavior the religion permits</p>

<p>
2. Gov&#39;t requiting conduct that a person&#39;s religions prohibits</p>

<p>
3. Law burdening or making more diffucult a persons religious observances</p>

| Successful Free Exercise Claim</p>

A

<p>
Must show that law is not neutral or generally applicaple to all people, regardless of religion. If shown, regulation is presumptively valid and may not be challenged.</p>

<p>
The regualtion will not be valid if the regulation places a SUBSTANTIAL burden on religious conduct, meaning religious conduct is punished for compliance or benefits are witheld based on belief of practice.</p>
