| Freedom of Religion Defined</p>
<p style="text-align: center;"> The 1st Amendment assures that “Congress shall make no law respecting the establishment of religion, or prohibiting the free exercise thereof.” </p> <p style="text-align: center;"> Two distinct Areas:</p> <p style="text-align: center;"> 1. Establishment Clause</p> <p style="text-align: center;"> 2. Free exercise Clause</p>

| Does the Regulation Violate the Establishment Clause?</p>
<p style="text-align: center;"> Is it discriminatory?</p> <p style="text-align: center;"> If yes (clearing favoring on religion of another):</p> <p style="text-align: center;"> Strict Scrutiny:</p> <p style="text-align: center;"> 1. Neccesary to acheive a compelling state interest, and</p> <p style="text-align: center;"> 2. Narrowly Tailored to that end</p> <p style="text-align: center;"> If no, Lemon Test:</p> <p style="text-align: center;"> 1. The regulation must a secular legislative purpose, </p> <p style="text-align: center;"> 2. The reulation neither advances nor inhibits religion, </p> <p style="text-align: center;"> 3. The regulation cannot foster excessive gov't entanglement with religion </p> <p style="text-align: center;"> </p>

| Free Exercise Clause, When Violation Occurs</p>
<p>
Three scenarios give rise to a violation of the Free Exercise Clause</p>
<p>
1. Government prohibiting behavior the religion permits</p>
<p>
2. Gov't requiting conduct that a person's religions prohibits</p>
<p>
3. Law burdening or making more diffucult a persons religious observances</p>
<p>
| Successful Free Exercise Claim</p>
<p>
Must show that law is not neutral or generally applicaple to all people, regardless of religion. If shown, regulation is presumptively valid and may not be challenged.</p>
<p>
The regualtion will not be valid if the regulation places a SUBSTANTIAL burden on religious conduct, meaning religious conduct is punished for compliance or benefits are witheld based on belief of practice.</p>
<p>
| If a substantial burden to religious practice is found:</p>
<p>
Strict scrutiny is required.</p>
<p>
Gov't Must:</p>
<p>
1. Assert compelling interest, </p>
<p>
2. Narrowly tailored to that end, and</p>
<p>
3. Employ the least restrictive means available.</p>
