Establishment or Services ?
Establishment : pursuit of an eco activity through a fixed establishment in another MS for an indefinite period (Factortame)
= permanent basis

=>dosent apply when confined to within a single MS
Establishment
- granted to natural and legal persons
- all types of self employed activity
- permanent activity : numerous criteria
- primary / secondary establishment
Justifications :
- exercise of official authority

Art 52(1) TFEU
-national measures liable to hinder or make less attractive the exercise of fundamental freedoms guaranteed by the Treaty must fulfil four conditions:
1) Applied in a non-discriminatory manner
2) Be justified by imperative requirements in the general interest
3) Be suitable for securing the attainment of the objective which they pursue
4) Not go beyond what is necessary in order to attain it (proportionate).
