Freedom of Disposition Flashcards
What is the aim of American property law and succession?
To facilitate the disposition of property, NOT regulate it
Succession
Transfer of a decedent’s property to a beneficiary
Dead Hand Rules
Protect a decedent’s disposition interests up to a point. Then they serve to prevent a dead person from exerting too much control over the living
Intestacy
When a person dies without a will
Laws of Intestacy
Laws that guide the transfer of intestate property
Freedom of disposition
The right of the decedent to lay out in life how they would like their property to be dispensed
Do future interests of a potential beneficiary matter?
no, because this is ‘mere expectancy’ which is irrelevant
Can your will go against public policy?
No,will cannot violate public policy.
EX:
-cant force people to get married in order to obtain property in your will
cant have someone destroy your property when you die because public policy doesn’t like waste
What is the logic behind freedom of disposition?
you have worked hard to amass your wealth in life and you should be able to dispose of it how you would like
