Freedom of Association Flashcards
Roberts v. Jaycees (1984)
Membership in the United States Jaycees was limited to males between the ages of eighteen and thirty-five. Females and older males were limited to associate membership in which they were prevented from voting or holding local or national office. 2 Minnesota offices decided to fully induct females into their chapter, but had their chapters revoke. The Supreme Court ruled against the Jaycees because freedom of association does not apply equally to all organizations.
Boy Scouts of America v. Dale (2000)
At the time of the case, Boy Scouts asserted that homosexuality was inconsistent with their values, forbidding gays to be in their organization. Dale was openly gay during college and was expelled from being a Scoutmaster. The Supreme Court ruled against Dale because they are a private organization and within their mission, it is said that homosexuality is against their morals and values and that would send a message to young boys that they tolerate homosexuality.
