PUblic Forums
Places that have been traditionally dedicated to a “free exchange of ideas” (i.e. parks, streets, sidewalks.)
The government can limit the scope of the public forum with content-neutral restrictions as long as they meet intermediate scrutiny (substantially related to an important government purpose)
Time place and manner
=Must be content-neutral and can’t focus on the message, but can focus on the circumstances under which the speech may be delivered
-must be substantially related to an important government interest
-must give opportunity for review; and
=must leave open ample alternative channels for communication of the information (can’t complete prohibit the speech)
Limited (Designated) Public Forums
Places intentionally created by the government to voluntarily establish a public forum (i.e. government making an auditorium a public forum)
The government can limit the scope of the designated public forum as long as the regulations are content neutral ( if content based, its examined through strict scrutiny)
Time place and manner restrictions must be content neutral
Non public forums
Placs that the government can regulate all speech as long as the regulations are reasonable and viewpoint neutral
Private Property
The first amendment doesn’t extend to speech on private property
