Q
What is voluntary manslaughter?
A
Voluntary manslaughter is a killing that would otherwise be murder but is distinguishable from murder by adequate provocation.
Provocation is sufficient to reduce killing from murder to manslaughter if it would arouse sudden and intense passion in an ordinary person, and there has been insufficient time for the passions of a reasonable person to cool.
Also, the defendant must actually be provoked and have acted under that provocation. (did not cool off).
