How long does a Deft have to respond to a request for waiver of service?
D will have 20 days from the date a request for waiver of service is received to return the waiver to the plaintiff.
Then Deft will have 60 days after receiving the request for waiver of service to respond to Pltf’s Complaint
How many days does a Deft have to answer a Complaint?
What if they file a pre-answer motion that gets denied?
In Florida, a defendant must serve an answer within 20 days of the original service of process of the initial pleading on the defendant.
But if the defendant files a pre-answer motion to dismiss and the court denies that motion, the defendant’s answer must be served within 10 days after that denial.
Deadline for Motion for Relief from Judgment
A motion for relief from judgment based on any of the above grounds must be filed not more than one year after entry of the judgment.
ECEPTION: If a party commits intrinsic fraud (i.e., fraud arising within a proceeding that pertains to issues in the case), the court may relieve the other party from a final judgment upon a motion for relief. This one-year limitation does not apply to fraud upon the court involving serious conduct that undermines the judicial process
When may a party make a demand fro jury trial?
“Any party may demand a jury trial of any issue triable of right by a jury by serving the other party with a demand in writing:
* at any time after the action commences and
- not later than 10 days after the service of the last pleading directed to that issue.”
