198A(1) Crimes Act 1961
Uses any firearm in any manner whatever,
Against any
- Constable
- Traffic officer
- Prison officer
Acting in the course of his or her duty
Knowing that, or being reckless whether or not that the person is a Constable, traffic officer, prison officer so acting
Liability for: Using any firearm against Law Enforcement Officer, etc. - Resist arrest
198A(2) Crimes Act 1961
Uses any firearm in any manner whatever
With intent to resist the lawful arrest or detention of himself, herself, or any other person.

198B(1)(a) Crimes Act 1961
In committing any imprisonable offence
Uses any firearm

While committing an imprisonable offence
Has any firearm with him or her
In circumstances that prima facie show an intention to use it in connection with that imprisonable offence.

Define Firearm
A firearm is anything that is capable of firing a bullet, shot, misile, or projectile by way of force of explosion.
- anything capable of being adapted to that
- anything with completion or adaption to that
- anything that is dismantled
- any specially dangerous airgun
Define: Airgun
Any air rifle, air pistol or weapon that a shot, bullet, misile, or projectile can be fired by way of compressed gas or air.
Define: Fire
Fire is a process of combustion, a chemical reaction between fuel and oxygen, triggered by heat.
