WHAT IS AN SBR (SHORT BARREL RIFLE)?

A

A short-barreled rifle is federally defined as a firearm with a rifled barrel and a stock where the barrel is less than 16” and/or the overall length is less than 26”. For purposes of measuring overall length when a folding or telescopic stock is attached, the measurement is taken from the crown of the barrel to the end of the stock when it is fully extended. Detachable muzzle devices do not count toward an SBR’s overall length.

WHAT’S THE DIFFERENCE BETWEEN AN AR PISTOL AND AN SBR?

A

The chief difference between an AR pistol and an SBR is the brace vs. the stock. Rifle stocks were designed to be placed into the shoulder of the shooter to aid in accuracy and stability. They can be made of any hard, dense, or rigid material such as wood, plastic, or metal. Some stocks are in a fixed position, whereas others can be folded or otherwise collapsed to aid in storage or make them more easily portable.

A brace, on the other hand, was designed to aid in the one-handed shooting of a pistol. The design theory behind the brace was to aid disabled shooters by allowing them to strap the brace to an arm to counter the weight of an AR or AK type pistol.

What is the difference between a PISTOL BRACE and a STOCK

A

A pistol brace outwardly resembles a stock but is typically made of rubber for the most part, although there are some newer ones made of plastic or even metal. They have a shorter length of pull and most often have straps of some type so that the shooter can attach it to their arm and fire it one-handed.

Stocks are designed so that the shooter can shoulder a rifle and thus aid in accuracy and stability. While the two are outwardly similar, in the AR pistol vs. SBR argument, the stock will almost always win from a design, comfort, and engineering standpoint.

What is a RIFLE according to the ATF?

A

ATF defines a rifle as a weapon that is fired from the shoulder and generally requires two hands in order to shoot it.

A rifle is a firearm designed to be fired from the shoulder and designed to use the energy of
an explosive in a fixed cartridge to fire only a single projectile through a rifled barrel for each single pull
of the trigger.

NOTE: A rifle subject to the NFA has a barrel or barrels of less than 16 inches in length.

NO…….Pistols are defined as firearms that were designed primarily to be fired with one hand so a VFG will run afoul of the law in most cases. A pistol with an overall length of 26” or less and a sub 16” barrel would be considered an AOW (Any Other Weapon) with a VFG attached.

What are “Machine Guns / Full Auto firearms”?

A

Machine Guns / Full Auto firearms = Firearms which expel more than one projectile by a single pull of the trigger.

A

SOT = Special Occupational Taxpayer

“SOT” means a special occupational taxpayer, a person or entity qualified to import,
manufacture, or deal in NFA firearms by having paid the special (occupational) tax to do so under the
NFA.

A

Short Barrel Shotguns (SBSs) = Shotguns which have a barrel under 18 inches in length or an overall length of less than 26 inches.

“What are “Any Other Weapons (AOWs)”?

A

Any Other Weapons (AOWs) = Are a complicated class of NFA firearms (yes, they really made a class of firearm called “Any Other”). This category includes disguised firearms (cane guns, pen guns, etc.), pistols with a foregrip, pistols designed to fire a shotgun shell with a smooth barrel, and more.

What are “Destructive Devices”?

A

Destructive Devices =

These are firearms that have a bore diameter greater than .5 inches (over 50 cal) and any explosive, incendiary, or poison gas, (A) bomb, (B) grenade, (C) rocket having a propellant charge of more than 4 ounces, (D) missile having an explosive charge of more than 1/4 ounce, (E) mine or (F) similar device.

I assume that the only Destructive Device that you’ll have to worry about are firearms over 50 cal. Each of these firearms can be treated as a normal firearm (non-NFA) if it has been exempted by the ATF for a sporting purpose. Therefore, 12 gauge shotguns aren’t Destructive Devices because they’ve been exempted.

What is “Form 1” use for?

A

Form 1 = This form doesn’t apply to FFLs. It is used by non-FFLs to make an NFA firearm.

A

Form 2 = This form is for Type 7 manufacturer FFLs to make an NFA firearm. This form is submitted AFTER the NFA firearm is made as a notification to the ATF (no approval required).
