When must fire orders be given? (3)
- When firearms are issued before the start of authorized carriage and pre-planned operations as a part of the op briefing.
- In all other operational situations where firearms are carried, if time and circumstances permit, supervisors must draw attention to F/O.
- Every time employees receive formal firearms training they must be asked by the instructor to demonstrate knowledge of F/O

Crimes Act sections 39, 40, 41, 48 & 62
An offender must not be shot without first considering… (3)
- Communication: they must have first been asked to surrender (unless unpractical or unsafe to do so)
- Less violent alternatives: It must be clear they cannot be disarmed or arrested without first being shot.
- Delay: It must be clear that further delay in apprehending the offender would be dangerous or impractical
Police must only use firearms for these lawful purposes (4)
-Defending themselves or others
-Arresting an offender
-Preventing escape
-Destroying animals

-cannot reasonably protect themselves or others in a less violent manner

Arresting an offender (3)
- believe on reasonable grounds the offender poses a threat of death/GBH in resisting arrest; and
- the arrest cannot be reasonably effected in a less violent manner; and
- the arrest cannot be delayed without danger to other people

Preventing Escape (3)
- police believe on reasonable grounds that the offender poses a threat of Death/GBH to any person (whether identifiable or members of the public at large)
- the offender flees to avoid arrest or escapes after arrest; and
- the flight or Escape cannot be reasonably prevented in a less violent manner
What are the Restrictions on Firing as set out in Fire Orders
There is no justification for firing at a suspect when they are no longer a threat to life. This applies regardless of the suspects previous actions
Although generally warning shots should not be fired, when may they be appropriate? (2)
- when the suspect has been asked to surrender (if practical) AND has not done so, AND
- it can be clearly aimed as a warning shot
