What is Res Judicata?
claim preclusion:
- you cannot relitigate claims,
- you cannot litigate claims that arise out of the same set of facts and circumstances you have already litigated
What is collateral estoppel?
issue preclusion: cannot relitigate issues essential to the final decision
What is the Finality Rule?
Parties are barred from re-litigating claims or issues which they have already litigated to a final judgment on the merits.
AG’s office brings a consumer fraud action against Leadtoys, Inc. A final judgment on the merits is entered against Leadtoys. The next day, a consumer files an action against Leadtoys alleging the same fraud. Can Leadtoys relitigate the same issue of fraud against the consumer’s suit?
No. Collateral estoppel.

What res judicata bars

The rule is founded upon

and that no person should be unnecessarily
harassed with the multiplicity of suits.
